1. Overview & General Terms

This site and service are operated by Shady Cactus Studio. By accessing our site, purchasing products, or commissioning artwork, you agree to be bound by these Terms & Conditions.

2. Physical & Print Products

• Color Accuracy: Due to variance in screen displays, physical print colors (including acrylic inks, spray paint gradients, and paint pen linework) may vary slightly from online product previews.
• Handmade & Custom Variance: Original artwork, hand-pulled prints, and spray-painted apparel feature inherent surface variations. These micro-differences are a natural characteristic of manual craft processes, not production defects.
• Shipping & Delivery: Risk of loss and title for physical merchandise pass to you upon delivery to the shipping carrier. International buyers are responsible for any custom duties, taxes, or import fees applied by local authorities.

3. Digital Content & Intellectual Property

• Ownership: All visual assets, vector line art, original illustrations, brand graphics, site design, and code on this website remain the sole intellectual property of Shady Cactus Studio.
• Permitted Use: Purchasing physical artwork, custom prints, or apparel grants you ownership of the physical item only. You may not reproduce, scan, redistribute, or commercially exploit any artwork or site code without explicit written consent.
• Custom Commissions: Unless a complete copyright transfer or exclusive commercial license is explicitly contracted, Shady Cactus Studio retains all moral rights and visual licensing rights to custom graphic works, including the right to display commissioned pieces for portfolio, marketing, and promotional purposes.

4. Orders, Returns & Refunds

• Standard Merchandise: Unused print products in original condition may be returned or exchanged within 14 days of receipt. Return shipping costs are the responsibility of the customer unless the item arrives damaged.
• Custom Works: Custom apparel prints, bespoke original art, and commissioned graphics are non-refundable once production or design execution has commenced.
• Damaged Goods: If a shipment arrives damaged, contact us within 48 hours of delivery with photographic evidence of both the exterior packaging and the damaged artwork to arrange a replacement or refund.

5. Website Usage & Modifications

We reserve the right to modify prices, update site content, or discontinue products or services at any time without prior notice. Unauthorized use of this site or attempt to scrape, reverse-engineer, or breach site security is strictly prohibited.
